Terms of Service

Please read these terms carefully before using Kumawat.

These Terms of Service ("Terms") form a binding agreement between you and Kumawat ("we", "us", "our") governing your access to and use of kumawat.site and our Text to Speech services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the Service. By using the Service you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. Your Account

  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You must provide accurate, complete information when creating an account and keep it up to date.
  • You may not share your account or create multiple free accounts to circumvent usage limits.
  • Notify us immediately at support@kumawat.site of any unauthorized use.

3. Subscriptions, Credits & Billing

  • Paid plans are billed in advance on a recurring monthly basis by Stripe.
  • Prices are displayed in U.S. dollars and may be subject to applicable taxes.
  • One-time credit purchases are charged immediately upon checkout.
  • Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date.
  • You may cancel a subscription anytime from your account dashboard; cancellation takes effect at the end of the current billing cycle.
  • We may change prices or plan features with at least 30 days' notice for existing subscribers.
  • Failed payments may result in suspension of paid features until payment succeeds.

4. Refunds

Refunds are governed by our Refund Policy. In summary: you may request a refund within 7 days of purchase for unused credits; no refund is available once all purchased credits have been used.

5. Acceptable Use

You agree not to use the Service to:

  • Generate audio that is illegal, infringing, defamatory, obscene, hateful, harassing or that incites violence.
  • Impersonate any person or entity, or clone a real person's voice without their explicit consent.
  • Create sexually explicit content involving minors, non-consensual sexual content, or content used for harassment.
  • Produce content intended to deceive (e.g. political disinformation, deepfakes, fraud, "vishing" scams).
  • Violate any applicable law, regulation or third-party right.
  • Reverse engineer, scrape, probe or attempt to bypass rate limits, authentication, or security controls.
  • Resell or redistribute access to the Service without a written commercial agreement.
  • Use automated means (bots, scripts) to interact with the Service beyond documented APIs.

We may suspend or terminate accounts that violate this section, without refund.

6. Content Ownership & License

You retain ownership of the text you submit. Audio generated from your text is licensed to you for commercial and non-commercial use, subject to these Terms. You grant us a limited license to process your text solely to operate and improve the Service.

The Service itself, including all software, voices, design, and branding, is owned by Kumawat and its licensors and is protected by intellectual property laws. No rights are granted except as expressly stated.

7. Voice Likeness & Consent

Our AI voices are synthetic. You may not use the Service to create audio that misleadingly imitates a real, identifiable person's voice without their explicit written consent. You are solely responsible for obtaining any consents required under applicable law.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable for maintenance, updates or reasons beyond our control. We are not liable for any loss resulting from downtime.

9. Third-Party Services

The Service integrates with third-party providers (Stripe for payments, voice synthesis providers, hosting, analytics). Your use of those services is subject to their own terms.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by law, Kumawat shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising from your use of the Service. Our aggregate liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Kumawat and its officers, directors, employees and agents from any claim, damage or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your content, or your use of the Service.

13. Termination

You may terminate your account at any time. We may suspend or terminate your access with or without notice if we believe you have violated these Terms or applicable law, or if continuing to provide the Service is not commercially viable. Sections that by their nature should survive termination will survive.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Kumawat operates, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
